Termination and redundancy – know your rights at ACC
27 June 2008, 11:05am
As you will be aware, many of your colleagues are currently subject to processes for termination of their employment with the ACC. Based upon budget estimations, it can be reasonably anticipated this will be an ongoing process over ensuing months and years.
While it appears non-ongoing employees and secondees are currently the primary targets of termination proceedings or redundancy offers, the ACC takes the position that the CEO has power under s.29(1) of the Public Service Act 1999 to terminate the employment of any APS employee in the ACC if they are considered excess, subject to the redundancy provisions in the ACC Collective Agreement 2007-2009.
Should any member be advised they are to be subject to termination proceedings or redundancy offers, it is essential they seek prompt advice as to their legal position. It is important to obtain legal advice before engaging in discussions about your position or making any decisions.
The CPSU can assist with the provision of legal advice to its members. Advice is available through the Member Service Centre on 1300 137 636, open from 8am – 8pm EST.
